[Board-2018] Fwd: Eric Eberhart

Greetings,
As stated earlier, this is a thorny mess!
As stated in our Constitution,Article XI – Membership, Section 4., “Active Membership includes individuals or families. Family is defined as two individuals living at the same address in a marriage or marital-type relationship." Accordingly, as Capt. Eberhart is married and lives with his wife at the same address he enjoys a family membership. However, neither our Constitution or By-Laws defines children of a family membership as Members. As far as I am aware, Capt. Eberhart has 3 children, two of which are living at the home of Capt. Eberhart and his wife. One of those children (Eric Eberhart) is approximately 28 years old and the other of the two children is 23/24 years old. If we now decide that the our definition of "Family" includes either or both Capt. Eberhart's 2 children that are living at home, then we are opening up the door to include " any child living at home with his/her parents regardless of the age of the child". I have a son living at home with my wife and I and he is 59 years old.
As this issue has ramifications that PYC has never addressed in the past, we should not, in this matter, create a new category membership without a great deal of discussion. Consequently, I am not in favor of Capt. Eberhart's request.
Art

Hi all,
Please help me understand. I don't have H&D with me.

Does Bob Eberhart have a family membership ?
If he does; isn't his son entitled to use the club and take the family's boat out?

Parking over night without permission issue I believe has been resolved.

Thanks
Wes

I also agree with most everyone. If we let him do this, who knows what could come up next. I do think putting an application in his hand is advisable….at least then he’ll know we want him as a member but there are rules.

I agree with all that has been said but I do feel that the fact is he is just getting to his dads boat and not using the club otherwise. Do they have a dinghy? Can he get himself to the boat via his own dinghy?

Just putting myself in this situation (hypothetically) and wondering how I would view it.

Regards,

Wendy Clement

I'm in agreement with what I sense to be the feeling of the previous emails on this topic. While I do feel for the situation, this would set a bad precedent moving forward and I don’t see how a decision like this could be justified. I am of the belief that we can’t make an exception for a non-member to use the club and/or docks for the summer for a fee, regardless of the situation.

I don’t think the launch is an issue, Bob has a slip. It might be hard trying to justify this exception for club usage.

Good afternoon,

Thank you for sending along this message. Even though I also sympathize, It is a slippery slope as Dan mentioned. All of the required insurance & licensure issues Art identified should be addressed immediately.

Eric should be invited to join and/or have a member with him. He could apply to be a member & have his Dad pay the fee & then he can use the launch.

Looking forward to the Parade of Sails tomorrow.

While I sympathize with Bob, this is a slippery slope. I think that the facilities are for the use of members only, and if his son wants to use his boat, he needs to become a member. Somewhat harsh, but if we let this slip, where will the line be drawn.
